Atelyr B.V. ("Atelyr", "we", "us", "our") attaches great importance to the protection of your personal data. This Privacy Policy applies when you visit our Website, use our Software or Partner Portal, or contact us.

2. What Personal Data Do We Process?

2.1 Data you provide yourself: name, email, phone, company name and address, VAT number, business registration number, job title, username, encrypted password. When accepting terms, IP address, device, browser, OS info, date/time of acceptance.

2.2 Automatically collected data: IP address, device data, browser/OS info, date/time of interactions, usage statistics, log files and error messages.

2.3 Payment data: billing address, payment history and invoice data. We do not store full payment details.

2.4 Conversation and metadata of AI agent interactions: audio recordings, AI-generated transcripts and summaries, interaction metadata, and personal data spoken or written during interactions. Atelyr processes these solely as a processor on behalf of the End Customer.

2.5 Data from incoming contact requests: phone number, email, content of conversations or messages, metadata, outcomes.

2.6 Sensitive data: The Software is not intended for processing sensitive personal data. Voice recordings are not used to identify individuals based on unique voice characteristics.

3. Purposes and Legal Bases

Atelyr processes personal data for: account management, software delivery, payment processing, onboarding, handling contact requests, administrative messages, commercial communications (with consent), partner management, software improvement (anonymised), security and fraud prevention, and legal obligations. Legal bases are consent, performance of a contract, legal obligation, and legitimate interest.

4. Retention Periods

  • Identification and contact data: duration of the Agreement plus 1 year; contracts and acceptance records: 5 years after termination.
  • Log files: max 12 months; usage statistics: max 3 years.
  • Payment data: 7 years (statutory).
  • AI agent interaction data: max 90 days, unless longer retention is necessary for handling a dispute or the End Customer has consented.
  • Contact request data: duration of Agreement plus 1 year, or 2 years after last contact.

5. Sharing of Personal Data with Third Parties

Atelyr only shares data when necessary, with categories of processors including payment providers, hosting parties, email providers, AI providers for product functionality, communication and collaboration platforms, support platforms, financial administration solutions, monitoring and logging providers, and professional advisors. Atelyr never sells personal data.

6. Transfer Outside the EU

Transfers outside the EEA take place only on the basis of adequacy decisions (incl. EU-US Data Privacy Framework), Standard Contractual Clauses, or other GDPR-recognised mechanisms.

7. Security

Atelyr applies appropriate technical and organisational measures including encryption, access control, monitoring, backups, periodic audits, incident management, and employee training.

8. Your Rights as a Data Subject

You have the right of access, rectification, erasure, restriction, data portability, objection, and withdrawal of consent. Requests may be sent to [email protected]. You have the right to lodge a complaint with the supervisory authority.

9. Cookies and Tracking Technologies

Atelyr uses functional cookies without consent and asks consent for analytical and marketing cookies via a cookie banner. See the Cookie Policy for details.

10. Changes to this Privacy Policy

Atelyr reserves the right to amend this Privacy Policy; changes are published on the Website.

11. Automated Decision-Making and Profiling

Atelyr does not use fully automated decision-making with legal effects within the meaning of Article 22 GDPR.

12. Minors

The Software is not intended for persons under 16. Atelyr does not knowingly process personal data of minors.
