2. Which Cookies Do We Use?

The cookies are listed below per environment: the Website (www.atelyr.ai) and the Software (the platform and applications).

2.1 Functional Cookies

Functional cookies are necessary for the correct functioning of the Website and the Software. Without these cookies, certain features cannot be offered. Functional cookies are placed on the basis of our legitimate interest or the performance of the agreement; no consent is required for these.

2.2 Analytical Cookies - None

Atelyr uses Simple Analytics to measure website visits. Simple Analytics is a privacy-friendly analytics tool that does not place cookies and does not collect personal data. No consent is required for this, and no cookie banner is shown for it.

Atelyr does not use Google Analytics, Meta Pixel, or other analytics tools that place cookies.

2.3 Partner Attribution (Affonso)

Atelyr uses Affonso to track referrals via the partner channel. On the Website, the related cookies are only placed after your prior consent via the cookie banner. In the Software, Atelyr stores the Partner identifier in session storage upon sign-up. No consent is required for this; the legal basis is legitimate interest.

Affonso acts as a processor on behalf of Atelyr. A data processing agreement has been concluded with Affonso that meets the requirements of the GDPR.

2.4 Contact and Helpdesk Functionality (Intercom Messenger)

Atelyr uses Intercom for helpdesk, support chat, and onboarding tours. In the Software, the Intercom cookies are functional and necessary for the requested service. On the Website, the Intercom Messenger is used to offer contact options (live chat) outside the contractual relationship with logged-in users. Consent is required for this. If consent is refused, the chat function on the Website will not be available.

3. Legal Basis

3.1 Functional cookies: Article 6(1)(b) GDPR (performance of a contract) or Article 6(1)(f) GDPR (legitimate interest).

3.2 Analytical measurement via Simple Analytics: no cookie; no legal basis required.

3.3 Partner tracking via Affonso and Intercom Messenger on the Website: Article 6(1)(a) GDPR (consent).

3.4 Legitimate interest: partner attribution via session storage in the Software (Article 6(1)(f) GDPR).

4. Retention Periods

4.1 The retention period for each cookie is listed in the full table in the downloadable PDF. After the retention period has expired, cookies are automatically removed from your device or deleted by our systems.

4.2 Session cookies are automatically deleted when you close your browser.

5. Your Choices and Cookie Management

5.1 On your first visit to the Website, we ask for your consent via a cookie banner for partner tracking (Affonso) and for the Intercom Messenger on the Website. You may grant or refuse your consent. Functional cookies and Simple Analytics are always used.

5.4 Atelyr does not respond to the "Do Not Track" signal that some browsers may send.

6.1 Atelyr does not share data collected via cookies with third parties for commercial or advertising purposes.

6.2 To the extent that cookie data is processed by processors acting on behalf of Atelyr, Atelyr concludes a data processing agreement with these parties that meets the requirements of the GDPR.

6.3 Some processors that process personal data in the context of this Cookie Policy are established outside the European Economic Area (EEA). Transfers to such parties take place only on the basis of appropriate safeguards.
